The App depends on third-party services (notably the ESPN public API) that may change, become unavailable, or restrict access at any time. If that happens, portions of the App may stop working. We have no obligation to maintain compatibility with any specific third-party service.
The App is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Your use of the App is at your own risk.
To the maximum extent permitted by law, Eklektikos Publishing shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to lost profits, lost data, or other intangible losses, arising from or related to your use of the App — even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any claim arising from or related to the App shall not exceed five US dollars ($5.00).

These Terms are governed by the laws of the United States and the State of Texas, without regard to conflict-of-law principles. Any dispute arising from or related to these Terms or the App shall be resolved in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction there.
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
